Ah, but the law says it's his, so you steal it back, you will get to enjoy prison food for a few years!

Find the guy you bought it from and see if he was smart enough to has saved the info/vin and he might even have pics of it and could talk to the cops as a witness, which brings you back to calling craigs list. Hmmmm! Seams like we are going in circls.

Yeah, I suggested the same things in an earlier post.  The previous owner might still have an old repair ticket, bill of sale, or other papers with the VIN# or engine #, either of which would identify the ped.  Maybe he listed it by VIN# on his homeowner's insurance records.

Since this thread has been running for several days now, everyone knows what they need to show they own their peds.  Thus one should be able to safely assume that nobody on this forum will ever have this problem in the future because they now have a bill of sale for their peds.

Also, they have pictures of the whole ped plus close-up pix of BOTH the VIN# and engine# for each ped they own.  If not they have no basis to complain if their ped gets stolen and they can't show the cops it's theirs.

I would also suggest 2 copies of those papers and pix, one set at home and the 2nd somewhere else in case one set gets lost or destroyed.

I agree, so even if this ped never gets recoverd, i think it opend every ones eyes to better protect them selves in the future. Sill it sucks a fucking theif got away with it. What if the guy really did buy it from some one else who stole it. Im always going to wonder that. I do remember seeing 3 mopeds on craigs list during that week, but i was also playing with search tempest so my memmorie is all mixed up from seeing 50 mopeds in diff states.

The guy he bought it from, Cole, buys and sells stuff like crazy.  He probably didn't save the VIN.

Uh, if you steal it back the law would then say it was yours... see?  And then you have Cole sign a Bill of sale dated with the actual purchase date and the VIN.  Then lay low.

If you know where yr moped is, steal it the fuck back. If I had half a clue where my or tom's was I'd go over there with a bat in one hand and a knife in the other and beg the fucker to try me. Its 2010, and its a moped, not a benz, steal yr shit back.

Forrest, one little problem with that idea.  Sam can't show anything with the VIN of his ped, but the guy who has it now has a police report that shows the VIN of the ped in his possession, so if Sam steals it the cops would have his ass

I finally got my bike back this past Friday! THANK YOU MARK!! The person who had it brought in into Carter's shop who went to Mark looking for parts. Mark went over there, realized it was mine and took a picture of the parking tag and wrote down the serial number. Mark told the shop owner what the story was and he ended up telling the guy who brought it in that it was stolen. I ended up talking to the guy on the phone and after some negotiating he agreed to sell it back to me for $80. He said he wanted to "do the right thing" but also said that he paid $200 for it so he wanted to get some money back. It is not in the condition it was in when it got stolen but still worth far more than $80. Kind of a bitter sweet victory but I am happy as hell to have it back. Thanks to everyone for your help!

Nice!  Sucks to pay $80 for your own bike, but totally worth having it back.

Any word on who he got it from?  And who they got it from?  And who needs to be beaten?

presumption of innocence , a hard pill to swallow
as THIS  little fiasco ( Sam's stolen, I didn't do it, held Ransom) played out,,, I spotted a Jawa,, that I had seen before,,, its current possessor,, tall skinny, boxer shorts , Scottish clan plaid, Shannon, Shaw, Simpson, somethin,,,the bill of his baseball cap,, could be used as a straight edge,, and he had 3 gold teeth,,,
one phone call, to determine it was actually owned by a guy named Gary,,, and I took it to his house.
I described a solex,,, and grande,, and told him to keep an eye out,,,,

Sam,

Get a bill of sale form, fill it out with the make, model, & year info on the ped, and the VIN and the engine #'s.  There is generally no place for the engine #, so just write it in on the form.  The reason for the engine #, is the thief may scratch off the VIN, but normally he won't think to remove the engine # too.  You might also write your name, address, and telephone number on a piece of paper, put it in a small baggie (to keep it dry) and put it inside the headlight bucket.

Then date it for when your bought the ped from Cole (estimate the date as closely as you can if you don't remember the exact date) and have Cole sign it.  Make a couple of copies, put one copy somewhere under the seat, in the tool pouch, or some other easy to get to place.  Put the original in some very safe place and the 2nd copy in a different place (at work, a friend's house, in your car, etc.)

Hopefully EVERYONE on this forum has already done all the above so that never again will the law let the thief keep a stolen ped because you can't show that it is yours!!

Take a picture of you with the ped, print picture, write a note on the picture with the vin and engine nuymber, put in a baggie and put it in the seatpost. Nobody steals a ped and messes with the seat. The note should say "If this moped still has this picture and no proof of sale from "your name", then it is stolen.

BOOM! Even if the guy sells it with a bill of sale, you can always prove it's yours. I learned this from the police in 6th fucking grade, yeah, TRY stealing my shit.
